TO BE ELIGIBLE FOR A DEFFERED DISPOSITION

  • You MUST have a valid DRIVER LICENSE
  • You CANNONT hold a CDL or CDL PERMIT Code of Criminal Procedure Art. 45.0511(s).
  • You CANNOT have committed the offense in construction zone with workers present. Code of Criminal Procedure Art. 45.0511(p)(3).

The deferral period can be from 1 to 180 days

If you are under the age of 25 you MUST also complete a mandatory drivers safety court.

THE COURT HAS SOLE DISCRETION ON GRANTING A DEFERRED DISPOSITION AND THE TERMS OF THE DEFERRAL.
